§ 40-368. Injunctive relief.

  • Whenever a user has violated any pretreatment standards or pretreatment requirements or continues to violate the provisions of this article, any pretreatment facilities permit issued by the IEPA or any other issued hereunder, the director may petition a court of competent jurisdiction through the village attorney for the issuance of a temporary or permanent injunction which restrains or compels the specific performance of any pretreatment standards or pretreatment requirements, the provisions of this article, any pretreatment facilities permit issued by the IEPA, or any order issued hereunder on any activities of such user. Such other action as appropriate for legal and/or equitable relief may also be brought by the village attorney on behalf of the village. A petition for injunctive relief need not be filed as a prerequisite to taking any other enforcement action against a user under this article.
