§ 8-134. Vicious dogs.

  • (a)

    It shall be unlawful and a violation of this section for the owner of any dog within the village to keep, maintain, abandon, sell or otherwise transfer any such dog that is found to be a vicious dog pursuant to the provisions of section 8-135. Any such vicious dog is hereby declared to be a nuisance and is subject to immediate impoundment.

    (b)

    Any vicious dog impounded under this section shall not be returned to its owner unless such dog is subsequently found not to be a vicious dog. Any dog subsequently found to be a vicious dog shall be humanely destroyed.

    (c)

    It shall be unlawful and a violation of this section for the owner of any premises to knowingly permit a lessee of such premises to move, keep or maintain a vicious dog on or within any such leased premises. Any owner of any such leased premises shall, upon learning of that any vicious dog is being so moved, kept or maintained, shall notify the lessee having any such vicious dog to immediately remove such vicious dog from such leased premises.
