§ 40-363. Notification of violation.

  • Whenever the director finds that any user has violated or is violating any of the provisions of this article, any pretreatment facilities permit issued by the IEPA or any other issued hereunder, or any other pretreatment standards of pretreatment requirements, the director may serve upon such user a written notice of violation. Within ten days of the giving of such notice, an explanation of the violation and a plan for the satisfactory correction and prevention thereof, that includes specific required actions, shall be submitted by any such user to the director. Submission of such plan shall in no way relieve such user of any liability for any violation of this article occurring before or after the giving of such notice of violation. Nothing in this section shall limit the authority of the village to take any other action, including any emergency action or any other enforcement action under this article or otherwise, without first issuing any such notice of violation.
