§ 38-1. Definitions.

  • (a)

    Whenever any words and phrases used in this chapter are not defined herein but are defined in the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.), as supplemented and amended, any such definition therein shall be deemed to apply to such words and phrases used in this chapter, except when the context otherwise requires.

    (b)

    The following words and phrases when used in this chapter shall, for the purpose of this chapter, have the meanings respectively ascribed to them in this section below, except when the context otherwise requires:

    Abandoned vehicle means any motor vehicle or other vehicle located on private or public property other than a street or highway or other municipal property that has not been moved or used for 48 consecutive hours or more and is apparently deserted or any motor vehicle or other vehicle located on a street or highway or other municipal property that has not been moved or used for more than 24 consecutive hours and is apparently deserted.

    Central business district means all streets and highways or parts of streets and highways within the area described as follows: all that area bounded by Tanner Street between Congress Avenue and Sangamon Avenue and Ohio Avenue between Sangamon Avenue and Grove Avenue on the west, Grove Avenue on the north, Century Boulevard on the east and Congress Avenue between Century Boulevard and Tanner Street and Sangamon Avenue between Tanner Street and Ohio Avenue on the south, including the entire width of any such street or highway forming such boundary.

    Chief of police means the chief of police, or his designee.

    Corporate authorities means the president and board of trustees of the village.

    Director of public works means the director of public works of the village or his designee.

    Disabilities registration plate or parking devise means any valid registration plate issued to a person with disabilities or to a disabled veteran by the Secretary of State of the State of Illinois pursuant to section 3-616 or 3-609 (625 ILCS 5/3-609 or 625 ILCS 5/3-616) of the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.) or any valid parking decal or device issued by any unit of local government pursuant to section 11-1301.2 (65 ILCS 5/11-1301.2) of the Illinois Vehicle Code (625 ILCS 5/1-100 et seq.), or any other license plate or parking decal or device issued by another jurisdiction, including any state or local authority thereof, district, territory or foreign country designating that a motor vehicle is operated by a person with disabilities or a disabled veteran.

    Hearing officer means such person who is appointed for such purposes from time to time by the village president and confirmed by the board of trustees.

    Illinois Vehicle Code means the Illinois Vehicle Code (625 ILCS 5/1-101 et seq.), as supplemented and amended.

    Inoperable vehicle means any motor vehicle or other vehicle incapable of, or prohibited from, being driven or moved due to the removal of the engine, wheels or other parts or the damage, disrepair or disuse of such vehicle; also, any vehicle not displaying valid registration plates or proper evidence of application therefor shall be an inoperable vehicle under this chapter.

    Posting authority means the director of public works or the chief of police, who by virtue of this chapter have authority to create a temporary no parking area and post temporary no parking signs under authority of this chapter.

    Relocator means any person or entity who is engaged in the business of removing any trespassing vehicle from private property by means of towing or otherwise and thereafter relocating and storing any such vehicle and who is required to have a relocator license.

    Residence district means all streets and highways or parts of streets and highways within any area having a residential or mobile home park zoning classification under the chapter 46, pertaining to zoning, including the entire width of all streets and highways or parts of streets and highways adjacent to any such area having a residential or mobile home park zoning classification.

    Temporary no parking area means an area in which parking would be otherwise lawful, but which has been posted with temporary no parking signs as provided for in this chapter.

    Temporary no parking sign means a temporary sign that shall bear the following legend: "No Parking [from (date, hours) to (date, hours)]—Violators Will Be Towed at Owner's Expense."

    Traffic compliance administrator means the village comptroller or his designee.

    Village traffic engineer means the person serving in the office of village traffic engineer as established under section 38-21.
