§ 20-287. Authority to issue notice to appear; penalties.

  • (a)

    In the event that any public nuisance is not abated or removed within the time specified within the notice or within such additional time as may be granted by the hearing officer upon appeal, the village inspector shall, in addition to the authority set forth in section 20-286, have the authority to issue a "notice to appear" as defined in section 107.1(c) of the Code of Criminal Procedure of 1963 (725 ILCS 5/107-1(c)) for any violation of section 20-282, and for this purpose the village inspector is hereby designated as a "peace officer" within the meaning of section 2-13 of the Criminal Code of 1961 (720 ILCS 5/2-13) for such limited purpose.

    (b)

    Any person violating any of the provisions of this article shall be punished by a fine of not less than $75.00 nor more than $750.00 for each offense. A separate offense shall be deemed committed on each day during or on which a violation of this article continues unabated or unremoved after the time specified in the notice served upon any such person or after any such additional time as may be granted by the hearing officer pursuant to this article.
